Explained: How Election commission became Modi's Commission
The Election Commission of India (ECI) is a Constitutional body established by the Constitution of India empowered to conduct free and fair elections in India. The Election commission is headed by a Chief Election Commissioner and two other Election Commissioners. This post should not remain vacant during any General elections.
In March 10, just weeks ahead of General election 2024, Arun Goel, an Election commissioner suddenly resigned from his post.This has come as a surprise and shook to many regarding the timing of his resignation. He had tenure till 2027. Anup Chandra Pandey, who was an Election commissioner retired on February 14, 2024 making election commission with just one member out of three. This happened for the first time in the history of election commission. Former secretary to the Government of India E.A.S. Sarma has written to President Droupadi Murmu raising concerns about the status of the Election Commission of India.
Earlier, Supreme court directed that a committee comprising the Prime Minister, the Leader of the Opposition in Parliament, and the Chief Justice of India to appoint the Election commissioners. In this way, Election commissioners appointment were neutral and free from ruling party influence.
But, Modi Government passed a new law in 2023 called "Chief Election Commissioner and other Election Commissioners (Appointment, Conditions of Service and Terms of Office) Act, 2023". This law was passed when 140 opposition MPs suspended from Parliament as they demanded debate into Parliament security breach that happened on December 11, 2023.
According to this law, an election commissioner will appointed by a selection committee headed by the Prime Minister of India and consisting of the Leader of the Opposition in Lok Sabha and a member of the Union Council of Ministers to be nominated by the Prime Minister. Chief justice of India is replaced by a member of Union council of Ministers. This has raised many questions regarding the neutrality of selection committee since ruling party will have more say over the appointments.
Just weeks before General election 2024, this committee was assigned to appoint 2 missing election commissioners. The committee comprised Prime Minister Narendra Modi, Home Minister Amit Shah and a leader of opposition, a Congress MP Adhir Ranjan Chowdhary.
Earlier, Chowdhury, who is part of the three-member panel has written to Legislative Department Secretary Rajiv Mani asking him to send him bio data and details of shortlisted candidates for election commissioners.
"A day before the meeting they had given me 212 names, but 10 minutes before the appointment they again gave me just six names." He added that the ruling party people are the majority in the panel with two members, and hence “they chose the candidates they wanted”.
Some questions still remain unanswered. Why did Arun Goel suddenly resigned just days before General election? Why was leader of opposition kept in dark about the details of the candidate? How and why did 212 candidates become just six candidates? Who decides if the election commissioner is free from political leaning since the new appoints had already worked under BJP's Home minister Amit shah. Is the role of opposition being crushed and silenced in our democracy?
